Outsourcing software development to India: what to check before you sign

India has one of the largest software industries in the world, and companies in the US, UK, Europe and Australia have been outsourcing development there for decades. The cost difference is real, but so is the variation in quality. The difference between a great outcome and a painful one usually shows up before you sign, if you know what to check.

We’re an Indian software company, so read this with that in mind. These are the checks we’d want a client to run on us.

Why companies outsource to India

  • Cost: experienced engineers at a lower rate than most Western markets.
  • Depth of talent: a huge pool of developers across web, mobile, cloud and AI.
  • Time zones: work can move forward while you’re offline, if it’s managed well.
  • English: widely used in business and technical work.

None of these guarantee a good project. They make one possible.

Check how they communicate

Communication problems cause more failed outsourcing projects than technical skill does. In the first conversations, notice:

  • Do they ask questions? A team that says yes to everything in the first call will say yes to everything during the project too, until the deadline slips.
  • Do they push back? You want a partner who tells you when a feature isn’t worth building.
  • Is it in writing? Ask for a written summary of the call. Its quality tells you a lot.
  • Who will you actually talk to? Meet the project lead and senior developers, not just a salesperson.

Contracts, IP and NDAs

Before work starts you should have:

  • An NDA, signed before you share anything sensitive.
  • A services agreement covering scope, milestones, payment terms, warranties and termination.
  • A clear IP clause stating that the code, designs and content created for you become yours on payment.
  • Agreed ownership of accounts: repositories, hosting, app store listings and domains should be in your company’s name, with the partner given access, not the other way round.

Process and visibility

Ask them to walk you through how a typical project runs, week by week. Good signs:

  • a discovery or planning phase before full development starts;
  • working software shown regularly, ideally on a staging site you can click through anytime;
  • a shared task board you can see;
  • code in a repository you own, with access from day one;
  • a written change process for scope changes, with costs agreed before work starts;
  • a plan for testing, launch and support afterwards.

Evidence when client names are confidential

Many good firms can’t show their best client work because of NDAs. You can still get evidence:

  • products they’ve built and run themselves (live apps and sites you can try);
  • work shown with the client’s permission;
  • a reference call with a past client, arranged privately;
  • a small paid trial project or discovery phase before committing to the full build.

Warning signs to walk away from

  • A fixed price for a complex project after a single call.
  • Reluctance to put the IP clause in writing.
  • Repositories or hosting kept in their name “for convenience”.
  • No senior person available after the sale.
  • Rates that are far below the market, which usually means very junior teams or hidden costs later.

Making it work day to day

Once you’ve chosen a partner, the habits matter more than the contract: a regular call slot in a shared working window, written updates, demos instead of status reports, and fast decisions on your side. We wrote a separate guide on working across time zones.
